1. The Promoter
- The “Promoter” is 2nd Era Limited, registered under Company Number 14283299, with its registered office located at Unit H3, Roman Hill Business Park, Broadmayne, Dorset, DT2 8LY. If you need to contact us for any reason, please email us at theteam@2ndera.co.uk.
2. The Competition
- These terms and conditions (the “T&Cs”) govern all competitions (the “Competitions”) listed on the Promoter’s website at www.2ndera.co.uk (the “Website”). These T&Cs apply to all interactions between the Promoter and you.
- In case of any inconsistency between the T&Cs and any listing on the Website, advertisement or other promotional materials used by the Promoter for a Competition, these T&Cs shall prevail.
- To participate and stand a chance of winning, each entrant in a Competition (an “Entrant”) must correctly answer a question or solve a problem posed by the Promoter (the “Competition Question”).
- All Competitions feature a Competition Question, and an entry fee is required each time you enter a Competition. However, a free entry option is also available.
3. How To Enter
- Competitions will be conducted within the specified times on the opening and closing dates outlined on the Website. These dates, denoted as the “Opening Date” and “Closing Date” respectively. Any times specified on the Website refer to London, England time.
- The Promoter reserves the right to alter the Opening Date and/or Closing Date if necessary. Any changes to these dates will be communicated on the Website.
- All entries for a Competition must be submitted to the Promoter by the specified time on the Closing Date. Entries received after this time (whether or not they were sent before) will automatically be disqualified and will not be entered into the Competition and no refunds will be provided.
- The maximum number of entries allowed for a Competition will be indicated on the Website. If the maximum number of entries is reached, further entries may be restricted.
- Each Entrant is limited to a certain number of entries per Competition, including free entries. The maximum number of entries per Entrant for a Competition will be stated on the relevant Competition webpage on the Website. Once this limit is reached, no additional entries will be accepted from the Entrant
- To enter a Competition using the paid entry method:
- Visit the Website and create an online account.
- Select the Competition you wish to enter.
- Provide your answer to the Competition Question.
- Online entries are charged at £5 per entry.
- Choose the desired number of entries and proceed to checkout.
- Agree to the T&Cs and complete the purchase.
- Upon online purchase of a Competition entry, the Promoter will send confirmation of the entry receipt to the Entrant.The Promoter shall not be liable for incomplete, lost, or delayed Competition entries due to any cause, including equipment failure, technical issues, or network problems.
- By purchasing entries or submitting a Competition entry (whether purchased or free), you affirm eligibility, acknowledge entering into a contract with the Promoter, and agree to abide by the T&Cs.
Free entry to a Competition is available under the following conditions:
- Visit the Website and create an online account.
- Complete the postal entry by including the following information with your postal entry:
- Details of the Competition you’re entering.
- Your full name.
- Date of birth.
- Postal address (including postcode).
- Contact telephone number and email address.
- Your answer to the Competition Question.
- Send the completed entry via first or second class post to the Promoter’s address: Unit H3, Roman Hill Business Park, Broadmayne, Dorset, DT2 8LY. You are responsible for paying for postage on your entry. Hand-delivered entries will be void and will not be entered into the Competiton.
Multiple free postal entries per Competition are permitted up to the maximum set by the Promoter as indicated on the Website. Each postal entry must be sent separately. Bulk entries (e.g more than one entry per envelope) will be counted as a single entry.
Free entries must be received by the Promoter before the Closing Date.
Entrants must have an account on the Website for an entry (whether paid or free) to be processed, with all details on a postal entry matching the account information.
4. Choosing A Winner
- All Entrants who correctly answer the Competition Question and submit their entry in accordance with the T&Cs will be entered into a random draw. A winner (the “Winner”) will be chosen through a random draw within 7 days of the Closing Date (the “Draw Date”).
5. Eligibility
- The Competitions are open to all residents of the United Kingdom only and who are 18 years of age or older at the time of entry.
- The following persons are not eligible to enter the Competitions:
- Employees or workers of the Promoter.
- Employees or workers of advertising agencies or Prize suppliers of the Promoter who are professionally associated with the Competitions or their administration.
- Immediate family members or households of individuals listed in the above two points.
- By entering a Competition, you affirm that you meet the eligibility criteria and are entitled to claim any Prize you may win.
- The Promoter may request proof of age, residence or eligibility to enter a Competition and claim the Prize. Delay or failure to provide such evidence to the Promoter’s reasonable satisfaction may result in disqualification from the Competition.
- The Promoter will not accept entries that are considered by the Promoter to be part of an attempt to manipulate or unfairly influence the outcome of the Competition. For example, entries that are automatically generated by a computer.
- Entries that are (a) incomplete (b) illegible (c) sent with incorrect postage (d) sent to the incorrect address and/or (e) do not comply with these T&Cs will be void and will not be entered into the Competition.
- The Promoter reserves the right to disqualify any Entrant whose conduct is deemed contrary to the spirit or intention of the Competition. This includes instances of rudeness or abuse directed towards the Promoter or associated individuals.
- The Promoter’s decision as to whether an Entrant (or their entry) is eligible for a Competition is final and the Promoter is not obliged to provide any reasons for disqualification.
- Where an Entrant or their entry is deemed ineligible for any reason (whether before or after an entry has been accepted), any Prize will be forfeited and entry fees will not be refunded under any circumstances, including:
- Discovery of ineligibility after entry into the Competition or after winning a Prize.
- Changes in eligibility criteria after entry into the Competition.
- Disqualification from the Competition by the Promoter for any reason.
If an Entrant engages in:
- Fraud (actual or apparent);
- Fraudulent misrepresentation;
- Fraudulent concealment;
- Hacking or interference with the proper functioning of the Website; and/or
- Alteration or unauthorised use of any website code;
all of their entries will be voided, no refunds will be provided, and they may be prohibited from participating in future Competitions.
6. The Prize
- The Prize for each Competition comprises a free vinyl wrap of the Entrant’s car by the Promoter (the “Prize”). Details of the Prize are believed to be accurate as of the Opening Date to the best of the Promoter’s knowledge, information and belief.
- The Winner is responsible for any costs or expenses involved in claiming or using the Prize other than those expressly stated above as being included as part of the Prize.
- The Prize may be subject to additional terms and conditions imposed by the supplier or other organisation connected to the Competition.
- If necessary, due to circumstances beyond the Promoter’s control, the Promoter reserves the right to substitute any Prize with a prize of equal or greater value. If any details of the Prize change, the Promoter will aim to update the Website promptly.
- Unless stated otherwise, there is no cash alternative for the Prize. However, the Promoter may, at its discretion, offer cash as an alternative to the Prize. The Prize is for the named Winner only and is not refundable, negotiable, or transferable to any other person.
- The Promoter makes no representations or warranties regarding the condition of the Prize. If the Prize is a vehicle the Promoter bears no responsibility for the Prize once it has been delivered. The Promoter has no obligation to provide a replacement Prize. The Winner is solely responsible for complying with all relevant laws and regulations concerning the vehicle, its operation, and ensuring safe and responsible use.
7. Winners
- One Winner will be selected per Competition.
- The decision of the Promoter is final, and no correspondence or discussion will be entered into.
- The Promoter will personally notify the Winner by email or telephone promptly after the Draw Date specified in the Competition listing on the Website, but no later than 7 days from the Draw Date.
- If the Winner cannot be contacted does not respond to the notification within 14 days of the Draw Date, the Prize will be forfeited and the Promoter reserves the right to offer the Prize to an alternative winner from the remaining eligible entries in accordance with the procedure described above (and that winner will also have 14 days to respond to their notification).
8. Claiming The Prize
- Winners must personally claim the Prize and may not authorise a third party to do so on their behalf and cannot nominate a third party to receive the Prize.
- Details regarding Prize delivery or collection are provided on the Website.
- If an Entrant wins a Prize then they must book their car in for the Prize within 2 weeks. If the Entrant fails to do so, the Prize will be forfeited and will no longer be available to them.
- If an Entrant’s personal details, including contact information, change, they should notify the Promoter promptly via email at theteam@2ndera.co.uk and in any event no later than 10 days before the Closing Date Notifications to the Promoter must include details of the competition entered, the Entrant’s old details and new details.
- Cash Prizes will be transferred directly to the Winner’s nominated bank account. The Winner must provide evidence that they are the account holder of the account. If the Winner would like the cash Prize to be transferred to a joint account, the Promoter accepts no liability for the cash once it has been transferred.
- Failure to provide such evidence to the Promoter’s reasonable satisfaction within 14 days will result in disqualification, and the Prize will be forfeited. In such cases, the Promoter reserves the right to offer the Prize to an alternative winner from the remaining eligible entries or dispose of it without liability to the Winner.
- The Promoter is not responsible and will not compensate if a Winner is unable or unwilling to claim the Prize.
- The Promoter reserves the right not to award any Prize if it is not claimed according to these T&Cs.
9. Limitation of Liability
- Whilst nothing in these T&Cs will limit or exclude the Promoter, its agents, or distributors’ liability for personal injury or death resulting from its negligence or fraud, the Promoter (its agents and distributors) will not be legally responsible to Entrants or Winners in respect of:
- Entries not received due to incorrect information, data transmission issues, or any other reason.
- Unauthorised access, theft, destruction, or alterations to entries.
- Technical malfunctions, errors, failures, interruptions, delays, or line failures.
- Inaccessibility or unavailability of network services, internet, or website.
- The winner’s use of the Prize.
- Any damage to property or loss incurred by the Entrant as a result of the Entrant claiming the Prize.
- Any losses that were not foreseeable to the Promoter or to the Entrant at the time of entry or which are caused by a third party.
10. Data Protection & Publicity
- By entering a Competition, you agree that your personal information provided with the entry may be used by the Promoter or its agents and suppliers to process your entry and for the purpose outline in the sub-clause below. Please see our Privacy Policy Privacy Policy for more details regarding how we process your personal information.
- If you win a Competition, you agree that your surname, county and entry number will be published on the Website for one week after the Closing Date.
- If you do not want your surname and county included on the list of Winners referred to above, you must notify the Promoter within a reasonable period of time before the Closing Date via email at theteam@2ndera.co.uk at least 48 hours before the Closing Date.
- If you win a Competition, you may be asked to participate in publicity.
11. General
- The Promoter reserves the right to update these T&Cs, with the latest version available on the Website.
- The Promoter may, at its sole discretion, exclude individuals from participating in the Competitions if there is a breach of these T&Cs.
- The Promoter may void, suspend, cancel, or amend a Competition due to circumstances beyond its control, with entry fee refunds provided if necessary.
- Competitions on the Website are not sponsored, endorsed, or administered by Facebook, and Facebook bears no responsibility for them.
- These T&Cs are governed by English law, and any dispute will be subject to the [exclusive] jurisdiction of the courts in the United Kingdom.
- It’s advisable to print a copy of these T&Cs for your personal records.
